Gun violence advocates rejoiced as they signed a package of six bills designed to reduce the threat of gun violence in Delaware.

The theme of the lawsuit filed this week is that the U.S. and Delaware constitutions prohibit the right to possess "common firearms" such as the AR-15 and other currently banned firearms. That language is not in any constitution, but the court said earlier rulings uphold the right of gun owners to protect their firearms collectively.

Calling modern guns "everywhere" in America, the lawsuit states, "In 2018, approximately 909,330 Ford F-150s were sold. That's twice as many modern guns sold in the same year."

The lawsuit also points out that the Delaware Constitution protects the rights of gun owners more than the U.S. Constitution because it "gives people the right to keep and bear arms for the protection of self, family, home, and property, and for hunting and recreation."

The swift passage of Democratic-backed bills on party-line votes, some of which had previously been introduced but failed, comes in the wake of the May 24 massacre of 19 elementary school students and two teachers in Uvalde, Texas. The gunman used an AR-15 rifle, like many other mass shootings, including one that killed 10 people outside a Buffalo grocery store 10 days before the rampage in Uvalde.

"It's not disproportionately used in crime, it's the other way around," he said, adding that FBI data shows that most firearms crimes are committed with guns.

But Mara Gorman, the Delaware leader for Moms Demand Action, the nation's largest public organization advocating for stricter gun laws, believes the new laws will pass the Constitution.

Under the bill, prospective buyers would have to complete a training course that includes gun safety and storage instructions and at least 100 rounds of live firing.

Delaware's gun ban has withstood legal challenges based on a 2013 Maryland law.

"They are using it to mass shoot innocent citizens as we have seen them use it repeatedly in the past months," he said. "I believe the public would like to see these tools not shared."

Gorman also noted that before Carney signs the bill on June 30, he would allow people with assault-style weapons to stay as long as they can prove they are legally present. They can also be taken to shooting competitions.
